Terms of Service​

Welcome to Amyann · Embodiment Arts. These Terms of Service ("Terms") are a binding agreement between you and us. They cover your use of our website and everything we offer. Please read them in full, together with our Privacy Policy and Disclaimers, which are part of these Terms.

1. Agreement & acceptance

These Terms govern your access to and use of amyann.art and any related pages, content, communities, communications, and Offerings (together, the "Services") provided by Amyann · Embodiment Arts ("Amyann", "we", "us", "our"). By accessing the Services, creating an account, or purchasing or participating in any Offering, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy and Disclaimers. If you are entering into these Terms on behalf of another person, you represent that you are authorised to do so. If you do not agree, do not use the Services.

2. Definitions

  • "Offerings" means any product or service we make available, including free practices, downloadable audios and guides, self-paced online courses, classes, memberships and communities, group programs and containers, live or virtual events and retreats, ceremonies, and private 1:1 sessions and mentorships.

  • "Content" means all material we provide: text, graphics, images, video, audio, downloads, software, and the methods and frameworks we teach (including The Sacra Method and Mythic Body).

  • "User Content" means anything you submit, post, or share through the Services, such as messages, comments, testimonials, and submissions.

  • "You" means the individual accessing or using the Services or purchasing an Offering.

3. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above, and material changes may be highlighted on this page or notified by email. Your continued use of the Services after changes take effect constitutes acceptance. If you do not agree to a change, stop using the Services and contact us about any active Offering.

4. Eligibility - you must be 18+

Our work addresses adult themes of sexuality, eros, embodiment, and intimacy. You must be at least 18 years old (or the age of majority in your place of residence, if higher) to access, purchase, or participate in any Offering. By using the Services you represent and warrant that you meet this requirement, that all information you provide is accurate, and that it is lawful for you to access this content where you are. We may refuse, suspend, or terminate access where we reasonably believe this is not the case.

5. Accounts & security

Certain Offerings require you to create an account or access a members' area. You agree to (a) provide accurate, current, and complete information; (b) keep your login credentials confidential; (c) be responsible for all activity that occurs under your account; and (d) notify us promptly of any unauthorised use. You may not share, sell, or transfer your account or access, or allow others to use it. We are not liable for any loss arising from your failure to safeguard your credentials, and we may suspend or terminate accounts that contain false information, are shared, or breach these Terms.

6. Educational nature, not medical, psychological, or therapeutic care

All Offerings are provided for educational and personal-development purposes only. They are not medical, psychological, psychiatric, psychotherapeutic, counselling, or other professional advice, diagnosis, or treatment, and are not a substitute for care from a licensed professional. Amyann is an educator and embodiment coach, not a physician, therapist, or licensed mental-health provider, and no doctor-patient, therapist-client, or other professional or fiduciary relationship is created by your use of the Services. Our full Disclaimers (including health, breathwork-safety, trauma, and consent disclosures) are incorporated into these Terms by reference, and you agree to them.

7. Assumption of risk & release

Somatic, breathwork, movement, energetic, sexual, and erotic-embodiment practices can produce strong physical sensations and intense emotional, psychological, or energetic experiences, including the surfacing of difficult memories or feelings. You acknowledge and accept these risks. You participate voluntarily and at your own risk, and you are solely responsible for your own physical and emotional wellbeing, for practising within your limits, for honouring your own consent and boundaries at all times, and for seeking appropriate professional support if needed. To the fullest extent permitted by law, you release and waive any claims against Amyann and its team arising from your participation, and you agree not to undertake any practice that is unsafe for you.

8. The Offerings

We offer a range of Offerings, each with its own description, inclusions, format, access duration, and terms shown on its page or at checkout. Unless stated otherwise:

  • Digital products & courses are licensed, not sold, for your personal, non-commercial use, for the access period stated (e.g., lifetime, or a set term).

  • Memberships & communities continue until cancelled or closed and are subject to community guidelines (Section 15).

  • Group programs & containers may have set start dates, cohort sizes, attendance expectations, and participation agreements.

  • Live events & retreats are subject to Section 13.

  • Private 1:1 sessions & mentorships are subject to Section 14 and may require an application.

We may modify, suspend, or discontinue any Offering or part of the Services at any time. Where we discontinue a paid Offering you have already purchased, we will provide reasonable continued access or a fair remedy.

9. Pricing, currency & taxes

Prices are shown at the point of sale and may change at any time; the price that applies to your purchase is the one displayed when you complete checkout. Unless stated otherwise, amounts are billed in Canadian dollars (CAD). You are responsible for any applicable taxes, duties, currency-conversion fees, or bank charges. We may correct pricing errors and cancel affected orders, refunding any amount paid.

10. Subscriptions & payment plans

Some Offerings are sold on a recurring-subscription or instalment-payment-plan basis. By choosing such an option, you authorise us and our payment processors to charge your payment method automatically on the stated schedule until the plan completes or you cancel as permitted. You are responsible for completing all instalments for any program you enrol in, even if you stop participating. If a payment fails, we may retry, suspend access, and/or treat the balance as immediately due. You can cancel a renewing subscription before the next billing date through your account or by contacting us; cancellation stops future charges but does not refund amounts already paid unless required by law or a stated guarantee.

11. Refunds & guarantees

Each Offering states its own refund policy on its sales page or at checkout, and that policy controls. In general:

  • Some Offerings carry an explicit satisfaction guarantee (for example, a 30-day money-back guarantee on certain self-paced courses). To use it, follow the steps and meet any conditions stated for that Offering (such as completing the practices) and contact us within the stated window.

  • Other Offerings are digital and immediately accessible, or are live, limited-capacity, or already commenced, may be sold on a final-sale basis.

  • Live events, retreats, and 1:1 work have their own cancellation and rescheduling terms (Sections 13–14), which may include non-refundable deposits.

Where you are entitled to a statutory right of withdrawal that cannot be waived, that right applies. If something isn't right, contact us and we'll do our best to make it good.

12. Coupons, credits & promotions

Coupons, discounts, scholarships, and credits (including credit from a lower-tier purchase applied toward a higher-tier Offering, such as a Liquid Gold credit toward The Bliss Code) are subject to the specific terms stated when offered. They have no cash value, cannot be combined unless stated, may be limited in quantity or time, are non-transferable, and may be withdrawn or changed. We may void promotions obtained through error, fraud, or abuse.

13. Live events & retreats

Registration for live or virtual events, retreats, immersions, and ceremonies is subject to availability and any additional event terms and participation agreement provided at booking. You acknowledge that in-person experiences carry inherent physical risks (including travel, movement, and group activities) and you assume those risks. Deposits may be non-refundable; cancellation, rescheduling, and transfer terms, along with any code of conduct, health requirements, and media/photography release, will be stated for each event. You are responsible for your own travel, insurance, visas, accommodation (where not included), and health needs. We may remove any participant whose conduct is unsafe, non-consensual, or disruptive, without refund.

14. 1:1 coaching & mentorship

Private sessions, mentorships, and high-touch programs are accepted at our discretion and may require an application and consultation call. They have their own scheduling, rescheduling, cancellation, late, and no-show terms (for example, a minimum notice period to reschedule), shared at booking or enrolment. 1:1 work is educational coaching, not therapy or medical care (Section 6). What you share is treated with discretion, but coaching is not a legally privileged or confidential relationship, and we may disclose information where required by law or to protect safety.

15. Community spaces & acceptable conduct

Some Offerings include access to community spaces (for example, group calls, forums, or a Telegram circle). These are shared, sensitive spaces. You agree to engage lawfully, respectfully, and consensually, and to keep the privacy and confidentiality of other participants. You agree not to:

  • harass, threaten, shame, "out", or discriminate against others;

  • share, screenshot, record, or repost others' words, images, or presence without consent;

  • solicit, spam, advertise, or recruit;

  • impersonate anyone or misrepresent yourself;

  • post unlawful, infringing, non-consensual, or sexually exploitative content, or anything involving minors;

  • provide medical, psychological, or other professional advice you are not qualified to give;

  • attempt to hack, disrupt, scrape, or circumvent the Services or their security.

We may monitor, moderate, edit, or remove User Content and may suspend or permanently remove anyone who breaches these Terms, without refund where permitted by law.

16. Your content & the licence you grant us

You retain ownership of your User Content. By submitting it (including testimonials, reviews, comments, and messages), you represent that you have the right to do so and that it does not infringe anyone's rights, and you grant Amyann a worldwide, non-exclusive, royalty-free, sublicensable, and (unless you tell us otherwise in writing) perpetual licence to use, host, store, reproduce, adapt, publish, and display that content for operating, promoting, and improving the Services. We may use first-name/initial attribution for testimonials unless you request otherwise. You can ask us to stop using a specific testimonial going forward by contacting us.

17. Intellectual property & restrictions

All Content and the Services, including the methods and frameworks we teach (The Sacra Method, Mythic Body), and all trademarks, logos, and brand features, are owned by or licensed to Amyann and protected by copyright, trademark, and other laws. Subject to these Terms and your payment, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use purchased Content for your own personal, non-commercial use during the applicable access period. You may not, and may not permit others to: copy, record, screen-capture, download (except where expressly enabled), reproduce, republish, distribute, sell, rent, sublicense, publicly perform or display, or create derivative works from any Content; share account access; or use the Content to train, build, or operate any competing product, service, or model. All rights not expressly granted are reserved.

18. Copyright complaints (DMCA/notice-and-takedown)

We respect intellectual property rights. If you believe content on the Services infringes your copyright, please email magic@amyann.art with: your contact details; identification of the work and the allegedly infringing material (with a link); a statement of good-faith belief that the use is unauthorised; a statement that your notice is accurate and that you are the rights-holder or authorised to act; and your signature. We may remove allegedly infringing material and terminate repeat infringers.

19. Third-party links, products & affiliates

The Services may reference or link to third-party websites, tools, platforms, and products, and may include affiliate links from which we may earn a commission at no extra cost to you. We do not control and are not responsible for third-party content, products, services, or practices, and a link or mention is not an endorsement. Your dealings with third parties are solely between you and them, on their terms.

20. Privacy

Our Privacy Policy explains how we collect, use, share, and protect your personal information. By using the Services, you acknowledge that policy.

21. Disclaimer of warranties

To the fullest extent permitted by law, the Services and Offerings are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage. We do not warrant that the Services will be uninterrupted, secure, error-free, or free of viruses or harmful components, that defects will be corrected, or that any particular result will be achieved. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

22. Limitation of liability

To the fullest extent permitted by law, Amyann and its owners, team, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or wellbeing, arising out of or relating to your use of (or inability to use) the Services or Offerings, even if advised of the possibility. To the extent liability cannot be excluded, our total aggregate liability for all claims relating to the Services or an Offering will not exceed the amount you paid us for the Offering giving rise to the claim in the twelve (12) months before the event. Nothing in these Terms excludes liability that cannot lawfully be excluded (such as for death or personal injury caused by negligence, or fraud).

23. Indemnification

You agree to defend, indemnify, and hold harmless Amyann and its owners, team, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: your breach of these Terms; your misuse of the Services or Offerings; your User Content; your violation of any law or third-party right; or your interactions with other users or third parties.

24. Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services or any Offering, with or without notice, if you breach these Terms, if required by law, or to protect the Services or others. On termination, your right to access paid Content ends, though we may, at our discretion, allow continued access where you have paid for a defined access period. Sections that by their nature should survive termination, including Sections 7, 16, 17, 21, 22, 23, 26, and 27 will continue to apply.

25. Force majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, natural disasters, illness or pandemic, war, civil unrest, strikes, failures of utilities, internet or third-party platforms, or government action. Where such an event affects a live event or retreat, we will offer a reasonable remedy such as rescheduling or a credit.

26. Governing law & dispute resolution

26.1 Informal resolution

If you have a concern, please contact us first at magic@amyann.art. We will try in good faith to resolve any dispute informally before formal proceedings.

26.2 Governing law

These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules, except where mandatory consumer-protection laws of your place of residence apply to you.

26.3 Courts

Subject to Section 26.4, you agree that the courts located in Toronto, Ontario, Canada will have exclusive jurisdiction over any dispute, and you consent to that jurisdiction and venue. Either party may still bring an eligible claim in a small-claims court.

26.4 Your rights preserved

Nothing in these Terms removes any non-waivable right you have under the consumer-protection laws of your place of residence (including, for Ontario consumers, Ontario's Consumer Protection Act, 2002), or any non-waivable right to bring a claim in your local courts. We have chosen not to require mandatory arbitration or to impose a class-action waiver on consumers.

27. General terms

  • Entire agreement: these Terms, with the Privacy Policy, Disclaimers, and any Offering-specific terms, are the entire agreement between us.

  • Severability: if any provision is found unenforceable, the rest remains in effect.

  • No waiver: our failure to enforce a provision is not a waiver of it.

  • Assignment: you may not assign these Terms; we may assign them to an affiliate or successor.

  • Electronic communications: you consent to receive communications and agreements electronically.

  • Notices: we may notify you via the email associated with your account or by posting on the Services.

  • Headings are for convenience only.
